A Polish court has postponed a hearing until 3 March as to whether a serial paedophile and murderer should remain in captivity after completing his 25-year sentence.

The district court in Rzeszow, south east Poland, is due to rule whether Mariusz T. (full name withheld under Polish privacy laws) has a mental disorder and as such must remain in isolation.

Technically, Mariusz T. completed his sentence at midnight on Monday.

Although Minister of Justice Marek Biernacki filed an application to the court calling for Mariusz T. to remain in captivity, it was still unclear on Tuesday as to whether the convict would leave prison in the meantime.

Child pornography allegedly found in Mariusz T.'s cell in recent days has been presented to local public prosecutors, and the possession of such material would in itself constitute a crime that could be punished by a further prison sentence.

Amid wide media coverage, police have said that if necessary, he will be monitored 24-hours per day if he is given parole.

In July 1988, Mariusz T. lured a 13-year-old boy to his flat in Piotrkow Trybunalski, central Poland, then raped and murdered the child and hid the body in the woods. Several weeks later he invited a further three boys to his flat. They all met the same fate as the first victim.

Prior to the murders he had been convicted of child abuse on several occasions during the 1980s.

Mariusz T. was initially sentenced to death in 1989, but all death sentences were commuted to 25-year prison sentences that same year, with the collapse of the communist regime in Poland. (nh)
