The Algerian man is the owner of a kebab restaurant outside which a fight led to a standoff with Police on New Year's eve, after the Pole set off a firework in the establishment in Ełk, in northeastern Poland.

The Algerian's lawyer has told the PAP news agency that the man claims he is not guilty.

He added that it is too early to reveal details of the incident.

Earlier on Monday, a 26-year-old Tunisian man, a cook at the restaurant, was also charged with the murder of the Pole.

Local media earlier reported that the victim had lit fireworks inside the restaurant, inciting a fight outside the establishment.

A spokesman of the district prosecutor’s office in Ełk said that the victim took two drink bottles and left without paying but that it is as yet unclear what set off the argument.

The victim was chased by the owner and staff and was then stabbed with a knife taken from the restaurant. Two stab wounds led to his death.

According to prosecutor Wojciech Piktel, the victim had previously been convicted on charges of threats and robberies.

The killing has led to at least two days of violence outside the restaurant, amid racial tensions in the region.

Hooligans threw bottles and rocks at riot police and the windows of the restaurant were smashed; which resulted in 28 people being detained.

A handful of organisations on social media have called for the boycott of “Islamic” Kebabs in Poland.

Meanwhile, Poland's Commissioner for Human Rights has taken the case after local media reported that the violence was racially motivated.(vb)
