Catholic weekly loses ‘abortion killer’ case

08.03.2010 06:22

The Gosc Niedzielny Catholic weekly lost its appeal, Friday, after accusing a woman of trying to kill her unborn baby, the Court of Appeal in Katowice ruled.

The court in Katowice upheld an earlier lower court’s ruling that Gosc Niedzielny and its publisher – archdiocese in the southern city of Katowice – will have to apologize to Alicja Tysiac and pay her 30,000 zloty (7,200 euro) in damages.

The weekly had appealed the verdict, claiming that it was “shockingly unfair.”

Alicja Tysiac is a mother of three. Several years ago Alicja was in danger of going blind on account of her pregnancy, but regardless of diagnosis doctors refused to perform an abortion. Throughout her pregnancy Alicja tried in vain to get an abortion, but her plea was refused repeatedly and she had to carry to term. After delivery her sight dramatically deteriorated. Alicja filed her human right violation claim against Poland in the European Court for Human rights in Strasbourg and won 25,000 euro damages

Gosc Niedzielny published a series of articles in which it accused Tysiac of attempting to kill her unborn baby and compared the woman with Nazi war criminals. Both courts decided that describing Alicja Tysiac’s case the weekly deliberately used expressions which were offensive, disdainful and aggressive. “Christianity is the religion of love and so should the language of the Catholic weekly be. Instead, it chose the language of hate,” said the judge.

“The crime that we’ve committed is that we had courage to openly say that abortion is equal to killing a man,” said priest Marek Gancarczyk, editor in chief of Gosc Niedzielny. (mg/pg)

A prime example of how religion is dangerous and ignorant.

Words fail me. At least there is still some common sense left in the judicial system.

Some might think religion is dangerous and ignorant but the truth is that most of Poland are religious and share the same beliefs and values. Since when does a judge have the right to say what can be said and preached by a religious organization? Freedom of Speech? Freedom of Religion? Why are they being limited when the priest's comments weren't even towards Tysiac. This article shows only one side of the medal.

This organisation may call itself Catholic but it shouldn't claim to be Christian. It's actions have been deplorable. The Catholic Church in Poland is a reactionary gang which is riding for a fall. Ireland 30 years ago was very similar, and look what happened there.

Why does the judge say what christianity should be like? Isn't that the job of priests or is there no distinctions in Poland? I'm glad with the outcome of the case but Poland is not there yet.

These comments indicate as if the Catholic Church in Poland is some kind of Islamic Regime. It seems as people here feel as the Catholic Church is throwing their beliefs and values down at everybody's throat. No other religious organization does more charity and missionary work around the world. If it wasn't for catholic missionaries around the world most of the 3rd world countries wouldn't have schools etc. It's very easy to throw stones. So ignorant.

Vicki, do you also support hamas because they too provide schooling and support for Palestinians?
Do you forget the murders when you hear that a serial killer is also a good husband? What is your opinion on the church's child abuse cases, corruption cases, are they ok because the church provides shelter? At what point will you decide that things have to change, 1 more case, 2, 10?
My opinion is to call out ALL cases and demand change, demand action, demand accountability, no more "I'm sorry" no more "we didn't know" the time of "wir haben es nicht gewust" is OVER.
It makes no sense to allow for some evil because an organization does some supposed good (also missionaries are NOT charity, they are catholic membership programs and are not done with the interests of the local population in mind)
Do not remain blind to the actions of the organizations that you support.

On the other hand I fully agree that the judge had no right to say "what can be said and preached by a religious organization" the judge should not have made that comment.

The Dominicans in Poland have ALL alternative and free-thinking people and bodies on file. Even aromatherapists are labelled as "sekta", what to speak of yoga, reiki and so on! Can you imagine this inquisition in the UK? Ha-ha! As for Vicki, it seems she's happy for Poland to remain the EU's biggest joke when it comes to Catholic intolerance!!
